Self-production and decriminalisation: what’s new in Luxembourg
The news came from the Ministry of Justice (Ministère de la Justice, MJUST) and the Ministry of Internal Security (Ministère de la Sécurité intérieure, MSI), which announced on 22 October 2021 that in Luxembourg it will be allowed to cultivate up to a maximum of 4 cannabis plants and only for personal use within a home or on one’s own property (including the garden). According to the new bill, therefore, every Luxembourg citizen over the age of 18 will be able to legally self-produce their own cannabis plants: a historic decision and move in Europe, where no state had yet officially embarked on this path.
Added to this is the intention of the two ministries to bring to the Chamber a vote to reduce the penalties that currently affect anyone found in possession of cannabis, even less than three grams. The idea is to move towards a gradual decriminalisation, reducing the consequences to the seizure of the cannabis – which would not entail any entry in the criminal record – and a fine that could range from €25 to €500; currently the fine can range from €251 to €5,000 and possession is considered a crime. On the contrary, the new legislation again confirms, in addition to the ban on smoking in public places , the ‘zero tolerance‘ for those caught with more than 3 grams and for motorists caught driving under the influence of cannabis.
