Cannabis referendum won’t happen: the Constitutional Court’s reasoning and the proponent committee’s rebuttal
The Constitutional Court has declared the referendum on cannabis inadmissible. Here are the reasons behind the decision and the referendum committee’s rebuttal.
The reasons for inadmissibility according to the Constitutional Court
After rejecting the referendum on euthanasia and the proposal on the civil liability of magistrates, the Constitutional Court also declared inadmissible the referendum on cannabis, which came to the court after the historic signature collection that reached the threshold of 500,000 signatures just one week after the launch and exceeded 600,000 in the suggessive days.
This was announced by Council President Giuliano Amato, who said, “The referendum was not on cannabis, but on narcotic substances. The question is divided into three sub-questions, and the first one provides that the cultivation of the drugs listed in Tables 1 and 3, which do not even include cannabis but do include poppy, coca, the so-called hard drugs, should disappear among the criminally punishable activities. This alone would be enough to make us violate international obligations.”
The correlation between soft drugs and hard drugs, however, had also already been addressed by the same referendum committee that expressed its views on the circulating fake news about the referendum, and it is just one of the points that have stirred controversy from the referendum committee’s promoters and among the referendum’s supporters.
